Morgantown, W.Va. — The Department of Labor this week announced significant changes to the Fair Labor Standards Act that determines jobs that are eligible for overtime. The adjustments change determination of which positions are subject to overtime pay for hours worked in excess of 40 in a workweek and doubled to $47,474 the salary level required to be considered exempt. While it is anticipated that the changes will have some impact on West Virginia University, teaching positions and certain other academic administrative positions are excluded from the requirements. Cris DeBord, vice president of talent and culture, said a planning group was formed a few months ago in anticipation of this change, and has been working on implementation. As the new law is not effective until Dec. 1, 2016, time remains for planning, education and compliance. It is important to note that because of the special rules for higher education institutions, general information in the media may not reflect precisely the impact on WVU.
